GENERAL TERMS AND CONDITIONS

This document sets forth the terms and conditions governing the use of the https://bruckners.eu/ website (hereinafter: “Service Provider”) for the sale of antique products (hereinafter: “Product”) via the website https://bruckners.eu/ (hereinafter: “Website”), as well as for persons participating in auctions (hereinafter: “Buyer”) (hereinafter: “GTC”).

Any technical information necessary for using the Website that is not included in these General Terms and Conditions is provided in other information available on the Website. The language of the contract is Hungarian, and the contract is not considered a written contract; the Service Provider does not file it, so it cannot be accessed or viewed at a later date, with the exception of order details. The Service Provider is not subject to the provisions of any code of conduct.

1.2. Terms and Conditions of Purchase and the Purchase Process

1.3. Registration All content on the Website is available to any Customer without registration; however, the purchase of individual Products and participation in auctions require registration.

1.4. Registration Process The Customer may register on the Website by clicking the “Log In” tab. To register, the Customer must provide an email address and a password. To finalize registration, the Customer must accept the provisions of these General Terms and Conditions and the Privacy Policy and click the “Register” button. If the Customer has not yet registered, they may also initiate registration on the order form during the ordering process.

1.5. User Account The Buyer’s user account is created upon registration. The user account allows the Buyer to track order and auction information. The Buyer may modify the information in their user account at any time.

1.6. Purchases: The Buyer may place an order for the Products available on the Website in the following ways:

1. Selecting a Product The products available for purchase can be found on the home page and the “Products” page. The Product Page displays: – a representative image of the product, – general information about the product, – the product’s price. Clicking on the product image displays a larger version of the image.

2. Starting the Order Process: Click the “Add to Cart” button on the Product Page to add items to your cart. You can view the contents of your cart by clicking the “Cart” icon in the upper-right corner.

                3. Checking the contents of the Cart You can view the contents of the Cart by clicking the “Cart” icon in the upper-right corner. You can remove a product from the cart by clicking the red “X” button; however, the quantity of a product cannot be changed. After removing a product, you must click the “Update Cart” button to remove that product from the cart.

4. Proceeding to Checkout If the contents of the Shopping Cart are correct, click the “Proceed to Checkout” button to proceed to checkout. On this page, you must enter your billing information and have the option to pay the purchase price by credit card. Please note that clicking the “Submit Order” button creates a payment obligation for the Customer!

5. Binding Offer, Confirmation The order constitutes a contract concluded between parties not present at the same time, which is governed by Act V of 2013 on the Civil Code and Act CVIII of 2001 on Certain Issues Concerning Electronic Commerce Services and Services Related to the Information Society. The contract is subject to Government Decree No. 45/2014 (II.26.) on the detailed rules governing contracts between consumers and businesses, and takes into account the provisions of Directive 2011/83/EU of the European Parliament and of the Council on consumer rights. The Buyer may place an order at any time. The order constitutes an offer by the Buyer, and the order will be confirmed via email shortly after it is submitted. The contract is concluded upon the Seller’s acceptance of your offer (via email confirmation).

6. Payment of the Product Price The price of the Product must be paid by credit card on the Checkout page. The prices listed on the Website are the prices valid at the time of the order, which the Customer will find next to the products. Prices are gross prices and include VAT. The Service Provider assumes no liability for prices that are obviously incorrect, despite its due diligence and/or due to an error in the IT system. The following, in particular, are considered obviously incorrect prices: – a price of 0 Ft, – a price reduced by a discount but incorrectly displaying the discount (e.g., a product priced at 1,000 Ft offered for 500 Ft while displaying a 20% discount). In the event of an incorrect price being displayed, the Service Provider shall offer the option to purchase the product at its actual price; with this information, the Customer may decide to order the product at the actual price or cancel the order without any adverse legal consequences.

7. Selecting a Delivery Method The Service Provider will deliver the Product to the Customer via postal delivery.

1.7. Auction Process and Purchasing

 Buyers can participate in auctions and bid on Products available on the Website as follows:

 8. Selecting a Product: Current auctions can be accessed by clicking on the “Auctions” / “Current Auctions” tab. Bids may only be placed on Products listed in active auctions. Products are purchased through bidding. The Product page displays: – a representative image of the Product, – the time remaining in the auction, – the minimum bid amount currently accepted. Clicking on the Product image displays a larger image of the Product, as well as the Product Information page, where you can also place a bid and view the current highest bid amount and the Product description.

9. Bidding You can place a bid on the auction page or the product page by clicking the “Bid” button.

10. Auction Closure The auction automatically closes (is awarded) at the highest bid price when the auction period ends. The Buyer becomes the winner of the auction if the bid they submitted was recorded in the system as the highest bid at the time the auction closed.

11. Binding Bid, Confirmation The Buyer is bound by their bid for the given Product after clicking the “Place Bid” button. The bid becomes non-binding if another Buyer places a bid higher than the Buyer’s bid.

In the event of a winning bid, the bid shall be deemed an order, and a contract shall be concluded electronically between the Service Provider and the Customer, to which Act V of 2013 on the Civil Code, and Act CVIII of 2001 on Certain Issues Concerning Electronic Commerce Services and Information Society Services. The contract is subject to Government Decree No. 45/2014 (II.26.) on the Detailed Rules Governing Contracts Between Consumers and Businesses.

In the event of a winning bid, the Service Provider will send the Buyer an email notification regarding the order after the auction closes. The Service Provider will send this notification no later than 1 business day after the auction closes. If the Buyer does not receive confirmation of the order within 72 hours, the Buyer may cancel the order.

1.8. Correcting Data Entry Errors At any stage of the ordering process and up until the order is submitted to the Service Provider, the Customer may correct data entry errors on the Website at any time via the order interface (e.g., removing a product from the shopping cart, changing the quantity, or modifying order details). Examples of data entry errors include an incorrectly entered quantity, placing the wrong product in the shopping cart, or typos in the order details, etc. If the Customer has finalized their order and discovers an error in the information provided, they must request cancellation of the order as soon as possible. The Customer may notify the Service Provider of the need to cancel the incorrect order by sending an email from the address provided at the time of ordering or by making a phone call. Afterward, a new order containing the correct information may be placed.

1.9. Sales Abroad The Service Provider does not discriminate against Customers within the European Union during the sales process. For sales abroad, the language of communication and purchase is Hungarian; the Service Provider is not obligated to communicate with the Customer in the language of the Customer’s Member State. The Service Provider is not obligated to comply with any non-contractual requirements established under the national law of the Customer’s Member State in connection with the relevant Service—such as labeling or sector-specific requirements—nor is it obligated to inform the Customer of such requirements. The Customer may exercise their legal remedies in accordance with these General Terms and Conditions. Payment shall be made in the currency specified by the Service Provider. The Service Provider may withhold performance of the Service until it is satisfied that payment for the Service has been successfully made using the electronic payment solution (including cases where, for services paid by bank transfer, the Customer transfers the purchase price in the currency of their Member State and, due to currency conversion and bank fees, and costs), and if the price of the Service has not been paid in full, the Service Provider may request that the Customer make an additional payment to cover the balance. 1.10. Invoice The Service Provider will send an invoice to the Customer via email.

 The package will be shipped to the specified delivery address via a courier service. If the Customer is not present at the specified address at the time of delivery, the courier will attempt delivery again. If the package is not accepted, it will be returned to the Service Provider. Delivery may be prevented by unforeseen circumstances; therefore, it is advisable for the Customer to provide a phone number or email address so that the courier can notify the Customer of the incoming shipment. If the Customer notices any damage to the Product or the packaging upon delivery, they must request that a damage report be drawn up or an existing report be amended in the presence of the delivery person. If the packaging or the Product is visibly damaged at the time of delivery, and the damage occurred prior to the Product’s receipt, the Service Provider will arrange for the return of the Product free of charge. The Service Provider assumes no liability for damage discovered after delivery. The Service Provider assumes no liability for delayed or failed deliveries resulting from incorrectly provided information.

1.12. A Vásárlót megillető elállási és szavatossági jogok Az e pontban foglaltak kizárólag a Fogyasztónak minősülő Vásárlóra vonatkoznak. Fogyasztónak minősül a szakmája, önálló foglalkozása vagy üzleti tevékenysége körén kívül eljáró természetes személy, aki a Honlapon árut vesz, rendel, kap, használ, igénybe vesz, valamint az áruval kapcsolatos kereskedelmi kommunikáció, ajánlat címzettje (a továbbiakban „Fogyasztó”). A Honlapon vásárolt termék esetében Fogyasztó jogosult: • a termék, • több termék szolgáltatásakor az utoljára szolgáltatott termék, • több tételből vagy darabból álló termék esetén az utoljára szolgáltatott tétel vagy darab, • ha a terméket meghatározott időszakon belül rendszeresen kell szolgáltatni, az első szolgáltatásnak, • a Fogyasztó vagy az általa megjelölt, a fuvarozótól eltérő harmadik személy általi átvételének napjától számított tizennégy (14) napon belül a vásárlásától indokolás nélkül elállni. Fogyasztót megilleti, hogy a szerződés megkötésének a napja és a termék átvételének napja közötti időszakban is gyakorolja elállási jogát. Ha a Fogyasztó elállási jogával élni kíván, elállási szándékát tartalmazó egyértelmű nyilatkozatát köteles eljuttatni (például postán, elektronikus úton küldött levél útján) a jelen ÁSZF 1. pontjában feltüntetett elérhetőségek igénybevételével a Szolgáltató részére. Ebből a célból Fogyasztó felhasználhatja a webáruházon keresztül elérhető elállási nyilatkozat – mintát is. Fogyasztó határidőben gyakorolja elállási jogát, ha a fent megjelölt határidő lejárta előtt elküldi elállási nyilatkozatát a Szolgáltató részére. A Fogyasztót terheli annak bizonyítása, hogy elállási jogát az Hiba! A hivatkozási forrás nem található pontban meghatározott rendelkezéseknek megfelelően gyakorolta. Mindkét esetben a Szolgáltató e-mailben haladéktalanul visszaigazolja a Fogyasztó elállási nyilatkozatának megérkezését. Írásban történő elállás esetén azt határidőben érvényesítettnek kell tekinteni, ha Fogyasztó az erre irányuló nyilatkozatát 14 naptári napon belül (akár a 14. naptári napon) elküldi a Szolgáltatónak. Postai úton történő jelzés alkalmával a postára adás dátumát, e-mail-en keresztül történő értesítés esetén az e-mail küldésének idejét veszi figyelembe Szolgáltató a határidő számítás szempontjából. A Fogyasztó levelét ajánlott küldeményként adja postára, hogy hitelt érdemlően bizonyítható legyen a feladás dátuma. Fogyasztó elállás esetén köteles a megrendelt terméket a Szolgáltató postai címére indokolatlan késedelem nélkül, de legkésőbb elállási nyilatkozatának közlésétől számított 14 napon belül visszaküldeni. A határidő betartottnak minősül, ha Fogyasztó a 14 napos határidő letelte előtt elküldi (postára adja vagy az általa megrendelt futárnak átadja) a terméket. A termék Szolgáltató címére történő visszaküldésének költsége a Fogyasztót terheli. Szolgáltatónak az utánvéttel visszaküldött csomagot nem áll módjában átvenni. A termék visszaküldésének költségén kívül az elállás kapcsán a Fogyasztót semmilyen más költség nem terheli. Ha Fogyasztó eláll a szerződéstől, haladéktalanul, de legkésőbb a Fogyasztó elállási nyilatkozatának kézhezvételétől számított 14 napon belül Szolgáltató visszatéríti a Fogyasztó által teljesített valamennyi ellenszolgáltatást, ideértve a fuvarozási (kiszállításért fizetett) költséget is, kivéve azokat a többletköltségeket, amelyek amiatt merültek fel, hogy Fogyasztó a Szolgáltató által felkínált, legolcsóbb szokásos fuvarozási módtól eltérő fuvarozási módot választott. Szolgáltató jogosult a visszatérítést mindaddig visszatartani, amíg vissza nem kapta a terméket, vagy Fogyasztó nem igazolta hitelt érdemlően, hogy azt visszaküldte: a kettő közül Szolgáltató a korábbi időpontot veszi figyelembe. Fogyasztó kizárólag akkor vonható felelősségre a termékben bekövetkezett értékcsökkenésért, ha az a termék jellegének, tulajdonságainak és működésének megállapításához szükséges használatot meghaladó használat miatt következett be. A Szolgáltató tehát követelheti a termék jellegének, tulajdonságainak és működésének megállapításához szükséges használatot meghaladó használatból eredő értékcsökkenés, illetve ésszerű költségeinek – ha szolgáltatásnyújtásra irányuló szerződés teljesítését a Fogyasztó kifejezett kérésére a határidő lejárta előtt megkezdte és gyakorolja felmondási jogát – megtérítését. A használat mértékét a Szolgáltató minden esetben egyedileg állapítja meg és ez alapján állapítja meg az esetleges értékcsökkenés mértékét! A visszatérítés során az eredeti ügylet során alkalmazott fizetési móddal egyező fizetési módot alkalma Szolgáltató, kivéve, ha Fogyasztó más fizetési mód igénybevételéhez kifejezetten a hozzájárulását adja, e visszatérítési mód alkalmazásából kifolyólag Fogyasztót semmilyen többletköltség nem terheli. A Vásárlót a Honlapon auckión vásárolt Termékek esetén a fogyasztó és a vállalkozás közötti szerződések részletes szabályairól szóló 45/2014 (II.26.) Korm. rendelet 29. § (1) bekezdés k) pontja alapján nem illeti meg elállási jog, mivel a Termék nyilvános árverésen kerül értékesítésre.

1.13. Warranty Rights

1.13.1. Warranty for Defects In the event of defective performance by the Service Provider (performance is considered defective, in particular, if the Product suffers from any defect in quality or quantity), the Buyer may assert a warranty claim against the Service Provider. Given that the purchased Product is used, the Buyer may assert warranty claims within a one-year statute of limitations period calculated from the date of receipt for Product defects that already existed at the time of delivery. The Buyer may no longer assert their warranty rights after the one-year limitation period has expired. The Buyer may, at their discretion, request repair or replacement, unless fulfilling the claim chosen by the Buyer is impossible or would entail disproportionate additional costs for the Service Provider compared to fulfilling another claim. If the Buyer has not requested or was unable to request repair or replacement, the Buyer may request a proportional reduction in the purchase price, or the Buyer may repair the defect at the Service Provider’s expense, have it repaired by a third party, or—as a last resort—withdraw from the contract. Withdrawal is not permitted due to a minor defect. The Buyer may switch from one chosen warranty remedy to another; however, the Buyer is obligated to bear the cost of such a switch, unless it was justified or the Service Provider gave cause for it. The Buyer is obligated to notify the Service Provider of the defect immediately upon its discovery, but no later than two months from the date of discovery. The Customer may assert a claim under the warranty of quality directly against the Service Provider. Within six months of the performance of the contract, there are no conditions for asserting a claim under the warranty of quality other than notifying the Service Provider of the defect, provided the Customer proves that the Product was purchased from the Service Provider (by presenting the invoice or a copy thereof). In such cases, the Service Provider is only exempt from liability under the warranty if it rebuts this presumption—that is, if it proves that the defect in the Product arose after the Product was delivered to the Customer. If the Service Provider can prove that the defect arose due to a cause attributable to the Buyer, it is not obligated to honor the Buyer’s warranty claim. However, after six months have elapsed from the date of delivery, the Buyer is required to prove that the defect identified by the Buyer already existed at the time of delivery. If the Buyer asserts a warranty claim with respect to a part of the Product that is separable from the rest of the Product—in light of the specified defect—the warranty claim shall not be deemed to have been asserted with respect to the other parts of the Product.

1.13.2. Product Warranty and Mandatory Warranty The Buyer is not entitled to a product warranty with respect to the Products, given that the Website offers the opportunity to purchase antique items, for which more than two years have elapsed between the date of manufacture and the date of the auction, and the product warranty is only available to the Buyer within two years of manufacture. The Buyer is entitled to a mandatory warranty only when purchasing new products; since only used products can be purchased on the Website, the law does not provide for a mandatory warranty in this case.

1.14. Legal Remedies

1.15. Place, Time, and Method of Complaint Handling: The Customer may submit complaints regarding the Service Provider’s activities through the contact information listed in Section 1. The Service Provider shall resolve verbal complaints immediately, if possible. If it is not possible to resolve the verbal complaint immediately—due to the nature of the complaint or if the Customer does not agree with how the complaint is being handled—the Service Provider will record the complaint and provide a substantive response within 30 days. The Service Provider will respond substantively to any complaint received in writing within 30 days. For the purposes of this contract, “response” means replying via email or sending a letter by mail. If the complaint is rejected, the Service Provider shall inform the Customer of the reasons for the rejection.

1.16. Other Remedies If any legal dispute between the Service Provider and the Customer cannot be resolved through negotiations with the Service Provider, the Customer is entitled to: – File a complaint with the consumer protection authority, – Initiate proceedings before a conciliation board. 1.17. Making Products Available for Sale Any natural person or business entity may make a Product available to the Service Provider. Products may be purchased at the Service Provider’s showroom. The Service Provider reserves the right to reject a Product and to determine its suggested retail price. The parties shall enter into a separate consignment agreement for the purchase of the Products.

1.18. Submission of Products for Auction Any natural person or business entity may submit a Product to the Service Provider for auction. Products may be submitted for auction at the Service Provider’s showroom. The Service Provider reserves the right to reject a Product and to determine the reserve price for the Product offered at the Auction. The parties shall enter into a separate consignment agreement for the submission of Products to the Auction. The Service Provider expressly prohibits the person submitting the Product to the Service Provider from bidding on their own Product on the Website. If it is determined that a bid was placed on one’s own Product, the Service Provider shall declare the bid invalid, suspend the user account used for bidding, and deduct the difference between the bid and the previous bid price from the amount of subsequent bids.

1.19. Other Provisions

1.20. Unilateral Amendment of the General Terms and Conditions. The Service Provider is entitled to unilaterally amend these General Terms and Conditions, provided that it notifies Customers in advance on the Website. The amended provisions shall become effective for the Customer upon their first use of the Website following their entry into force and shall apply to matters initiated after the amendment. The Service Provider further reserves the right to make any changes or corrections to the Website at any time without prior notice. The Service Provider also reserves the right to move the Website to a different domain name.

1.21. Copyrights The Website as a whole, its graphic elements, text, and technical solutions are protected by copyright or other intellectual property rights. The Service Provider is the authorized user of all content displayed on the Website and in the course of providing the services accessible through the Website, including any copyrighted works or other intellectual property (including, among other things, all graphics and other materials, the layout of the Website’s interface, editing, the software and other solutions used, and the implementation) Saving or printing the content of the Website, as well as any of its parts, onto a physical or other data storage medium is permitted only with the Service Provider’s prior written consent. Neither the use of the Website nor any provision of the GTC grants the Customer the right to use or exploit any trade name or trademark appearing on the Website. Beyond the display associated with the intended use of the Website, the temporary reproduction necessary for such use, and the creation of copies for personal use, these intellectual works may not be used or exploited in any other form without the Service Provider’s prior written permission. Unless otherwise agreed, it is prohibited to modify, copy, add new data to, or overwrite existing data in the Service Provider’s database by circumventing the interface or search engines provided by the Service Provider.
